FREMONT INDOOR CRICKET COMPLEX (FICC)

IMPORTANT NOTICE – READ CAREFULLY
THESE TERMS OF SERVICE CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. BY ACCEPTING THESE TERMS, YOU AGREE TO RESOLVE DISPUTES THROUGH INDIVIDUAL ARBITRATION RATHER THAN IN COURT.
If you do not agree to these Terms, you must not use Fremont Indoor Cricket Complex facilities, website, booking platforms, or services.
1. Introduction
Welcome to Fremont Indoor Cricket Complex (“FICC,” “we,” “our,” or “us”), located at:
40645 Fremont Blvd, Unit 30, Fremont, CA 94538
FICC is a private indoor sports rental facility that offers space for indoor cricket games, training, camps, leagues, private bookings, and related services.
These Terms & Conditions (“Terms”) govern:
- Use of the premises
- Facility rentals and reservations
- Online booking systems and waivers
- Participation in activities, training, and events
2. Acceptance of Terms
By accessing, booking, signing a waiver, entering the facility, or participating in any activities at FICC, you acknowledge and agree that:
✔ You have read, understand, and agree to be bound by these Terms
✔ You agree to abide by all safety rules, posted signage, and staff instructions
✔ You agree to the FICC Privacy Policy, incorporated by reference
If booking on behalf of a team, minor, group, organization, or corporate entity, you confirm that you are authorized to accept these Terms for all participants.
3. Eligibility
To use FICC services, you represent and warrant that:
(a) You are at least 18 years old, OR are a parent/legal guardian signing for a minor
(b) You have not been previously suspended or removed for safety or conduct reasons
(c) Your use of FICC is compliant with all applicable laws and regulations
4. Facility Rental Terms
Rental Assignment
When a booking is confirmed, you are assigned a lane, cage, bay, or area for use during the rental period.
Rental Duration
FICC may offer rentals as short as 30 minutes up to full-day or multi-day bookings, subject to availability.
Extensions
Extensions must be requested and approved by FICC staff. Extensions are not guaranteed and may incur additional fees.
Subleasing Prohibited
Subleasing or transferring rental time to any third party is strictly prohibited.
5. Payments, Refunds & Cancellation Policy
All payments are final. No refunds are issued for:
- Customer cancellations or no-shows
- Late arrivals or early departure
- Team/participant disputes

FICC may provide a refund or credit only if FICC is unable to provide the rental space due to:
- Power outage or facility closure
- Equipment or lane malfunction that materially prevents use
- Safety-related shutdown
FICC reserves the right to determine if a refund or credit will be issued.
6. Accuracy of Information
While we attempt to provide current and accurate information, FICC does not guarantee pricing, availability, or facility information will be error-free and may change without notice.
7. Notice
Official notices to FICC must be delivered via certified mail to:

8. Termination of Access
FICC may suspend or terminate access or remove any participant for:
- Unsafe behavior
- Property damage
- Harassment, abuse, or discrimination
- Violation of these Terms or posted rules
No refunds provided in such cases.
9. Coaching & Private Training Rules
To protect participant safety and maintain a consistent training environment:
1. Coaches must:
- Carry appropriate professional liability insurance if not employed by FICC
- Ensure that all athletes follow facility safety rules
- Report any injury or incident to FICC staff immediately
2. FICC may suspend coaching activity due to:
- Safety issues
- Overcrowding
- Equipment or facility maintenance
- Policy violation
10. Alcohol, Drugs, and Prohibited Substances
FICC is a drug- and alcohol-free sports environment.
The following are strictly prohibited within the facility and parking areas:
- Alcohol consumption or possession (unless explicitly permitted during an FICC-approved private event)
- Smoking, vaping, or tobacco products of any kind
- Illegal drugs or controlled substances
- Being under the influence of alcohol or drugs while participating in activities, especially indoor cricket play
FICC reserves the right to refuse entry, remove individuals, or terminate bookings without refund if a participant is suspected to be under the influence or impaired.
11. CCTV / Video Surveillance Notice
For safety, security, and operational purposes, FICC uses video surveillance (CCTV) in public and common areas.
By entering the facility, you acknowledge and agree that:
- You may be recorded on video
- Footage may be used for security, incident review, liability defense, and operational improvements
- FICC may share recordings with law enforcement or legal representatives when legally required
Surveillance is continuous and has no guaranteed monitoring in real time.
12. Photography, Video Recording & Media Consent
FICC occasionally records or photographs activities for marketing, safety, league coverage, and promotional purposes.
By entering the facility or participating in activities, you grant FICC:
A worldwide, royalty-free, irrevocable license to use your (or your minor participant’s) image, voice, and likeness in:
- Photos and video
- Livestreaming or archived match footage
- Website and social media posts
- Promotional and advertising materials
If you do not consent, you must notify FICC management in writing before participation. FICC will take reasonable efforts to accommodate, but cannot guarantee exclusion from incidental background footage.
Participants are permitted to take personal photos and videos unless:
- It disrupts play or safety
- It captures minors without parent/guardian consent
- It interferes with coaching or league operations
FICC may restrict use of recording devices at any time.
13. Limitation of Liability
To the maximum extent allowed by law, FICC shall not be liable for any:
- Injuries, including serious injury or death
- Property damage, loss, or theft
- Business or financial losses
- Indirect, incidental, punitive, or consequential damages
Your sole remedy for dissatisfaction with FICC is to discontinue use of the facility.
14. Dispute Resolution & Binding Arbitration
YOU AGREE THAT ANY DISPUTE WITH FICC WILL BE RESOLVED BY BINDING ARBITRATION and NOT IN COURT or before a jury.
No class or representative claims are permitted.
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in Alameda County, California.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
16. Release of Liability & Indemnification (Waiver Agreement)
APPLYING TO ALL PARTICIPANTS INCLUDING MINORS
By entering FICC or signing the waiver, you acknowledge and agree:
⚠ Indoor cricket is a physical sport with inherent risks including injury or death.
⚠ You voluntarily assume all risks associated with participation.
⚠ You release and hold harmless:
FICC, its owners, members, employees, coaches, contractors, affiliates, landlords, and equipment providers from all claims for injury, death, property loss, or damages.
You further agree to indemnify and defend FICC against claims arising from your or your group's use of the facility.
17. Revisions to Terms
FICC may modify these Terms at any time. Updated Terms will be posted and become effective immediately. Continued use of the facility constitutes acceptance.
18. Severability
If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.
